Agent Checklist for a Successful Closing

If you are the Buyer's Agent:

  1. Whenever you turn in the Earnest Money/Contract to Stewart Title or as soon as possible thereafter, please provide us with your Buyer's mortgage company name(s), loan officer/processor names, telephone/fax numbers along with all applicable e-mail addresses.
  2. As soon as possible, please provide us with your Buyer's insurance agent name, phone/fax, and e-mail address.
  3. Please provide your commission disbursement authorization (aka CDA), if applicable.
  4. Upon receipt of the Title Commitment, please review Schedule C for any items/issues that need to be provided and/or cleared prior to closing. As quickly as possible, please provide relevant documentation and/or contact names.
  5. Whenever you turn in the Earnest Money/Contract to Stewart Title or as soon as possible thereafter, please advise your Escrow Officer and/or Escrow Assistant as to whether the Buyer's closing papers will be a "mail-out," or if a Power of Attorney will be used.* *Power of Attorney forms must be approved in advance by Stewart Title as well as the Buyer's Lender.
  6. Please call to schedule your closing appointment at least one week in advance.
  7. Remind your Buyer(s) that they will need to bring a bank cashier's check made payable to Stewart Title for their portion of closing costs.* Also remind them to bring two forms of valid government issued identification such as a Passport, Driver License, ID card, Social Security card, etc. *Please refer to the final, approved HUD Settlement Statement for the exact closing [costs] amount due.
  8. Please remember that your Buyer(s) and the Escrow Officer (aka Closer) need closing instructions and loan documents from the [Buyer's] mortgage company at least 24 hours in advance of closing to allow ample review and preparation time.

If you are the Seller's Agent:

  1. As soon as possible, either included with the Earnest Money Contract or under separate cover, please provide us with the Seller's existing loan(s) payoff information - mortgage company name(s), loan number(s), telephone/fax numbers, and social security number(s).
  2. Please include a copy of the Listing Agreement with the Contract.
  3. Please provide your commission disbursement authorization (aka CDA), if applicable.
  4. Upon receipt of the Title Commitment, please review Schedule C for any items/issues that need to be provided and/or cleared prior to closing. As quickly as possible, please provide relevant documentation and/or contact names.
  5. Please provide a copy of the existing survey if it is to be used for closing provided there have been no structural modifications/improvements made to the property since the original [survey] date.
  6. Please advise the Escrow Officer/Escrow Assistant the name of the Home Warranty company that will be used, if applicable, as well as the person/party responsible for ordering such.
  7. Please fax or e-mail copies of repair and/or other invoices to be paid "out-of-closing" to the Escrow Officer or Escrow Assistant prior to the actual closing time/date ...furnishing invoices during closing will cause a delay.
  8. Please advise your Escrow Officer and/or Escrow Assistant as to whether the Seller's closing papers will be a "mail-out," or if a Power of Attorney will be used.* *Power of Attorney forms must be approved in advance by Stewart Title.
  9. Please call to schedule your closing appointment at least one week in advance. Please call the day prior to confirm your closing time.
